ISSUES IN IMPLEMENTATION OF MURABAHA CONTRACT

Abstract

This research aims to introduce the Islamic Murabaha contract by explaining its concept, importance and legality. This research also deals with the conditions for the correct completion of this contract and showed the most important points for each issue. I also clarified the most important problems that murabaha is exposed to, from profit margin problems, the contract formula, and others.

Among the most important findings of the research is that Islamic murabahah is one of the most successful Islamic financing tools in Jordan, and what is evidenced by the great dealings in it and the adoption of Islamic banks to it is very large. Also, the murabahah contract exposed some problems in the formulation of the contract.

One of the most important recommendations reached by the research is to work on developing Islamic murabahah models applicable in contracts. And work to control contract implementation processes and full knowledge of Sharia controls and adherence to them and the orders issued by the Sharia Supervisory Board and the Central Bank.
