Construction Projects Disputes In Iraq: Definitions, Causes, Categories And Resolving

Abstract

This research aims to identify the factors affecting the disputes arising in construction projects, the main purpose is avoiding the negative paths and preventing deviations that cause project delay resulting from dispute resolving procedure, and all other factors affecting the schedule whether acceleration or delay the project works, and thus avoiding the resulting claims. In order to achieve the research objective, in the theoretical part, it had benefited from reviewing scientific resources and references including books, researches, and specialized studies in the research subject. In addition, there was the practical part; a field study conducts through interviewing experts in all the aspects of engineering related to construction projects working in both government and private sectors in Iraq. Accordingly, questionnaire forms prepare to collect data and it distributes on a selected sample. Finally, the results of the field survey and the questionnaire presents to clarify the results that were reached, which are the effective causes of disputes and disputes’ category, in addition proposals for resolving disputes of construction projects without litigation.
